Definitions
The Student – thats you the person enrolling
Programme – this the course of study you are enrolling in
Provider – Officially you will be studying with New Zealand Institute of Education (2007).

Pre-enrolment
The Student acknowledges that all application documentation submitted by the Student for enrolment into this Programme is true and accurate, and they have assessed the Programme as being fit for their purpose, and that they have selected the Programme through a rigorous and informed process.
- The Student has been provided with all the relevant information by a representative from the Provider to make an informed decision on their enrolment.
- It is the Students responsibility to review the details of the Programme and assess the Programme against their expectations.
- In submitting all application documentation and the enrolment form, the Student has made an informed decision that the Programme will assist them in achieving their career intentions and goals.
- The information in the Student’s enrolment application and the submitted documents are true and complete.
It is the Students responsibility to disclose any health, disabilities or learning difficulties that may affect their ability to participate in their chosen Programme
Police Preparation students: It is the Students responsibility to disclose any criminal convictions, previous disqualifications from the NZ Police recruitment process or other potential obstacles to the NZ Police recruitment process.
Student Fees [if applicable]
- The Student pays all due fees directly into the New Zealand Public Trust account set up by the Provider for the Programme as stated in the Offer of Place. Please note that fees received through the Government Fee-Free scheme are not required to go to Public Trust.
- The Student acknowledges that the provider will inform Studylink of any non-attendance after 5 days or not meeting course work requirements. This may lead to a suspension of Studylink financial support.
- The Student understands that the provider will employ the services of a debt collection agency to recover any outstanding Programme fees, and that cost of any debt collection will be added to the Student’s account.
- The Student’s entitlement to a refund in the event of a termination by the Student is governed by the annexed Provider’s Refund Policy.
- From time to time, student fees may be paid to the Provider after the course start date. For example, due to delays in Studylink processing of fees. The student acknowledges that the refund policy is still in place irrespective of the date of the fee payment.
- For the avoidance of doubt, where a termination is invoked by the provider or the Student as a result of the Student’s behaviour or circumstances (for example but not limited to: continued unexplained absence from study, provision of false or misleading information, inadequate academic progress by the Student, imminent or prolonged departure for family and/or medical reasons), the Student is not entitled to a refund unless required by law.
- The Providers financial liability to the Student is limited to the amount of tuition fees, Programme related cost and registration fees and any other charges on my fees account that have been paid for the enrolment period in which the liability arises. Therefore:
- The Provider is not liable for any indirect or consequential losses (including loss of opportunity, loss of future earnings or loss of reputation); and
- The Provider is not liable for any losses, costs or damages suffered or incurred as a result of a breach of this Contract where that breach has been caused by circumstances beyond the provider’s reasonable control.
Engagement and Attendance
- The Student will take all steps to engage fully in the Programme, including on and off-campus learning time and assessment requirements.
- The Student acknowledges that the provider expects 90% percent attendance for all scheduled classes. The student acknowledges the hours of study stated in the Offer of Place
- The course Timetable will be set prior to the start of each Term;
- The Student acknowledges that the timetable for each term of study may differ from the previous term. The Provider reserves the right to change the timetable after consulting with students.
- The standard full-time study commitment at the provider is 30 hours per week, and that includes directed and self-directing learning. The standard part-time study commitment is 20 hours per week.
- Where the Provider identifies that the Student is not engaged fully in their Programme or where course completions are a concern, the provider will develop a personal learning plan or a modified programme of study designed to enable the Student to complete their Programme.
- Where the Provider identifies that the interventions (personal learning plan or a modified programme of study) are not improving performance, or the Student remains disengaged in their learning, the Student acknowledges that they may find that they complete the Programme unsuccessfully.
- The Student acknowledges when their learning remains disengaged or where course performance does not improve despite the interventions (such as a personal learning plan or a modified programme of study) that the Provider is entitled to discharge its contractual obligations and will not be liable for any compensation claims from the Student.
Data Collection
The Student permits the provider to share personal information with agencies with whom the provider has a contractual obligation for delivery of programmes, and Students abide by all of the provider’s policy and procedures.
- The Student understands that the provider will furnish information about them to third parties or agencies with whom the provider has a contractual obligation for delivery of programmes.
- The Student gives the provider authorisation to share personal information to third party or agencies with whom the provider has a contractual obligation on the understanding that the provider will observe the general conditions governing the release of information, as set out in the Privacy Act 2020.
- It is the Students responsibility to inform the provider of any change of address, contact details (email and phone number) as soon as these details change.
- The Students acknowledge that this is not a self-directed programme and attendance and engagement with the classes is required with the directed and self-directed learning hours.
- The Provider will deliver the Programme within the agreed Enrolment Period and delivery mode. The provider will deliver the Programme to the enrolled students within the Enrolment Period.
- The Provider reserves the right to modify the Enrolment Period if, due to circumstances out of their control, delivery of the Programme is suspended for a period of time. Examples may include (and not limited to): natural disaster, mass medical issues including pandemics or unplanned National events).
The Provider’s Responsibilities
- The Provider will ensure that all classes are scheduled and that the required resources (rooms, furniture and teaching staff) are provided in a healthy and safe environment.
- The Provider will set the Programme schedule before the start of the Programme.
- The Provider will set the timetable prior to the start of each Programme.
- The Provider reserves the right to deliver the course at an alternative delivery site, due to circumstances out of their control. Examples may include (and not limited to): natural disaster, mass medical issues including pandemics or unplanned National events.)
- The Provider will ensure that an appropriately qualified and experienced Tutor will deliver the course.
- The Provider cannot guarantee that the same Tutor will deliver the course for the duration. The Provider reserves the right to change Tutors as required due to operational requirements.
- The Provider will abide by the New Zealand Health and Safety at Work Act (2015).
Student Support
- The Provider will make available Student Support and Administration Services to Students.
- The Provider will make available all Student Support services and administration functions to all Students so that they have the support and systems to engage in their learning.
- Where a Student has disclosed to the Provider any health, disabilities or learning difficulties, The Provider will ensure that as far as practicable appropriate support and services are considered prior to the Student’s final enrolment being confirmed.
- Where Students have not disclosed any health, disabilities or learning difficulties, the Provider may not be able to provide the support required to address these issues.
- The Provider will abide by Legislation and Codes that are appropriate for the delivery of tertiary education in New Zealand, in particular:
- The Provider will abide by the requirements of the Education (Pastoral Care of Domestic Tertiary Students) Code of Practice 2019.
- The Provider will abide by the New Zealand Acts of Parliament, namely (but not limited to) the Education and Training Act (2020), Vulnerable Children Act (2014), Privacy Act (2020) and the Health and Safety at Work Act (2015).
- The Provider will establish a New Zealand Public Trust Account for the Student [note: Fees received through the Government Fees-Free scheme are not required to go to Public Trust.]
- The Provider’s Learning Management System will remain accessible to the student up to one month after completing the programme. Any students who withdraw earlier than the programme end date will have access removed at the time of withdrawal.
Privacy of enrolment information
New Zealand Institute of Education [trading as NZIE, MSL Training and Thrive Hive] collects and stores information from the Enrolment form to:
Manage the business of the organisation (including internal reporting, administrative processes and selection of scholarship and prize winners, Comply with the requirements of the Education Act 1989 and other legislation relating to maintenance of official records and accountability for public funding and Supply information to government agencies and other organisations as set out below.
In signing this enrolment form you authorise such disclosure on the understanding that NZIE will observe the general conditions governing the release of information, as set out in the Privacy Act 1993, the Education Act 1989 and other relevant legislation. You may see any information held about you and amend any errors in that information. To do so, contact the Enrolments Officer.
NB: The Privacy Act came into force on 2020 with the stated aim of protecting the privacy of natural persons. It requires the Provider to collect, hold, handle, use and disclose personal information in accordance with the twelve information privacy principles in the Act. https://www.privacy.org.nz/privacy-act-2020/privacy-principles/
MSL Training Ltd supplies data collected on this form to government agencies, including:
The Ministry of Education (student statistical returns), The New Zealand Qualifications Authority (Record of Achievement registration and Unit Standard outcomes), The Tertiary Education Commission (funding returns), The Ministry of Social Development (in relation to student loans and allowances) and Inland Revenue (Student Loans), Immigration New Zealand and the Ministry of Business, Innovation and Employment (for those who are not New Zealand Citizens or Permanent Residents), Agencies which support particular students through scholarships, payment of fees or other awards (if you are a recipient of one of these awards)
Those agencies use the data collected from tertiary education organisations to:
Administer the tertiary education system, including allocating funds, Develop policy advice for government and Conduct statistical analysis and research.
Your personal details (name, date of birth and residency) as entered on this form will be included in the National Student Index and may be used in an authorised information matching programme with the New Zealand Birth Register.
The government agencies above may supply data collected on this form to Statistics New Zealand for the purposes of integrating data with data collected by other government agencies, subject to the provisions of the Statistics Act 1975. Integrated data is used for the production of official statistics, to inform policy advice to the government and for research purposes.
In handling data supplied by you on this form, the government agencies are required to comply with the provisions of the Privacy Act 2020.
When required by law, New Zealand Institute of Education [trading as NZIE, MSL Training and Thrive Hive] releases information to government agencies such as the New Zealand Police, Department of Justice, Ministry of Social Development, and the Accident Compensation Corporation (ACC).
Information collected on this form may be supplied to other educational organisations for the purpose of verifying academic records.the Provider
